November “Informed Voters, Informing Voters” Fact Sheet: States are not Absolutely Required to Educate non-citizen children of illegal aliens This issue was initially addressed by the U.S. Supreme court in the case of Pyler vs. The State of Texas. (Cite) The court was sharply divided (5 to 4) over this issue with the dissenters believing the Court was conducting inappropriate Judicial Legislation. The Court found that Texas failed to prove its case including that Texas’ burden to educate the non-citizen children of illegal aliens was unreasonable or that doing so significantly detracted from the education of Texas’ own citizens. This case has not been modified or clarified as the politicians of the States have failed to secure the relevant and appropriate data by which they can prove it is an unreasonable burden upon the State to have to educate the non-citizen children of illegal aliens.
